Non-Refundable Deposit.

Buyer acknowledges that the Deposit is refundable in all circumstances, including but not limited to if Buyer decides s/he does not want or is no longer able to take the puppy. Upon receipt of the Deposit, Breeder agrees to hold the puppy for Buyer until it has been weaned and is ready for pick up. All payments under this Agreement shall be made in dollars and paid to Breeder.

Buyer Acknowledgements.

Buyer further acknowledges and agrees that (a) Breeder cannot control litter sizes and that the wait time for puppies can be longer than expected; (b) the Deposit gives Buyer a pick place, but does not guarantee a puppy or that Buyer's preferences will be available when it is Buyer's turn to pick; (c) pick places are given on a first-come first-served basis and Buyer's place in line is not negotiable; and (d) Breeder cannot and does not guarantee any specific qualities of the puppy when it becomes an adult.

Final Purchase Price.

Breeder and Buyer agree that (a) the Deposit shall be applied to the final purchase price of the puppy and (b) the remaining balance will become due before the puppy is shipped and/or ownership is transferred from Breeder to Buyer. The total purchase price for the puppy is stated above. The foregoing purchase price does not include any delivery or shipping charges.

Governing Law.

The Breeder Agrees:

To the best of Breeders knowledge the puppy is in good health at the time of sale. The buyer will have 5 business days in which to have the puppy examined by their own veterinarian or there will be no guarantee. If the puppy is found to be ill by a licensed veterinarian and is to be returned due to illness, a letter from the veterinarian is required. This includes death or illness from any health condition deemed to be present prior to leaving the seller’s premises. Buyer shall assume any expenses associated with returning the puppy to the seller. The seller will, at the seller’s discretion, refund the purchase price, return the dog to the buyer in healthy condition, OR exchange the dog for another dog of equal value. At no time and under no circumstances will the Breeder be responsible for any veterinary expenses incurred by the Buyer.

This animal is warranted against FATAL GENETIC Defects of the heart, liver, kidneys, and lungs for 1 year from the date of purchase. *

Should this puppy be determined to be suffering from a fatal defect deemed to be hereditary (within 1 year from the date of purchase), Breeder will replace the puppy with one of the same value when one is available after notification and written verification has been furnished to the Breeder by TWO independent veterinarians. The buyer’s licensed veterinarian must provide the Breeder with a written certificate stating the exact cause of death verified by a necropsy/autopsy within 2 days. The breeder will not be responsible for any veterinary costs at any time. We cannot guarantee that your puppy will never develop any health problems, just as a pediatrician cannot guarantee that a child will never develop any health problems in the future. Some things are just not able to be predicted.

Breeder does NOT GUARANTEE: *

Against COCCIDIA or GIARDIA (typically dormant single celled parasites common in puppies) or for final adult weight, color, breeding ability, show potential or against Parvo, hypoglycemia (low blood sugar), overbites, underbites, patella issues, hernias, trachea issues or for undescended testicles. Seller agrees to notify buyer if they or the vet discovers any of the above problems prior to sale. By selecting this statement, you agree that you have read and understand what BREEDER does and does not guarantee for.

The Breeder states: *

That the puppy has received the following vaccination- a 5-way Vaccine for Distemper, Parainfluenza, Adenovirus Type 2, Canine Hepatitis and Parvovirus (at 7-8 weeks old). Your health record will inform you of when a booster is due, your puppy will need 2 more puppy vaccines and rabies at 16 weeks old and then yearly boosters. Please see your puppy’s health record for details on the health care your puppy has received while with the breeder.

Deposits: *

A refundable deposit of $350-$500 will hold your puppy; this is included in your purchase price. DEPOSIT: The deposit will only hold one puppy or one spot on our waitlist. Once a deposit is received, to avoid stomach upset in your puppy during the stress of moving to a new home, you must also purchase your puppy's food through the website link the breeder has provided 10 days BEFORE puppy goes home, unless otherwise indicated and approved by the Breeder/Seller.

Puppy Value: *

The value of the puppy for purposes of this Health Guarantee is limited to the Purchase Price of the puppy, and does not include taxes, shipping, health certificate and veterinarian costs, shipping crate or any additional costs or expenses incurred or asserted by the Purchaser/buyer.

Since the seller/breeder has no control of the puppy's environment or lifestyle once it leaves the kennel, all health issues will be the responsibility of the puppy buyer.

Health Guarantee: Your Obligations

YOU MUST FULFILL THESE OBLIGATIONS, AS EXPLAINED HEREIN, OR THIS HEALTH GUARANTEE WILL TERMINATE AND BECOME NULL AND VOID.

Photo Rights: *

We love to receive pictures and testimonials of your puppy! If you send Breeder pictures, Buyer hereby authorizes copyrights to the breeder and photos can be used on our website and social media outlets. We truly appreciate your correspondence!

No Monetary Returns: *

Breeder will not accept any returns of the puppy for monetary refund for any reason including, without limitation, allergies, landlord/tenant restrictions, marital issues, puppy adjustment problems or any other reason. If the buyer must return the puppy for any reason, it will be on a surrender basis only with no refund or credit. Buyer and Breeder can negotiate all costs associated with transport back to the breeder. Upon any such surrender, breeder shall use commercially reasonable efforts to find a new home for the puppy through Breeder’s rehoming program.

Puppy Surrender: *

Breeder retains first right of refusal, if Buyer cannot keep puppy, the buyer agrees to contact breeder first before rehoming the puppy. Breeder will always allow a puppy from our kennel to be returned without judgment or criticism. We realize that life has unexpected things come up and we would never want a puppy from us to be in an Animal Shelter. We will lovingly accept a surrendered puppy and appreciate our buyer for the time, expense, sadness, and sacrifice it takes to make a decision to return their fur baby.

Cancellation by Buyer: *

Until such time as Buyer has received confirmation from breeder about the date upon which the puppy will be delivered, Buyer may cancel purchase of the puppy by notifying Breeder. In the event the Buyer cancels the purchase, the Buyer understands and agrees that the deposit of $350-$500 will be retained by the breeder.

Shipping: *

As soon as the puppy is ready for travel, the puppy will typically ship after 8 weeks of age, but occasionally a puppy may need additional time with its breeder before shipping. The final determination of the shipping date for the puppy is made by the puppy's breeder and the breeder's veterinarian, with the health of the puppy being the primary determining factor. Occasionally there may be delays for numerous reasons including, but not limited to, weather, temperature restrictions, logistics, mechanical failure or other unforeseen events. The Breeder shall not be liable, directly or indirectly, for any delays including, without limitation, those that may cause Purchaser inconvenience or financial loss, nor shall any delay be a valid cause for cancellation of Buyer’s purchase of the puppy. Buyer understands and agrees that no refund shall be provided by Breeder due to any airline/airport delays or cancellations of the puppy's flight, whether such travel is domestic or international. Buyer is responsible for any and all costs associated with travel of puppy and is solely responsible for any required documentation, health reports, or vaccinations that may be necessary to transport the puppy into any country other than the United States.

Buyer Acknowledgements: *

Buyer is to provide proper medical care and proper feeding, (do not overfeed your puppy, always follow feeding guidelines and weigh your puppy regularly to ensure the proper amount of food is being fed). Do not allow extreme jumping, run long distances on a leash, or bike with your puppy before 2 years old, this could cause health problems for your puppy including injury. Do provide fresh water for your puppy at all times. Purchaser is aware that owning a puppy can be a large financial responsibility and that he/she will be responsible for all costs associated with all veterinarian visits, such as but not limited to any veterinarian costs associated with illness, worming, parasites, spaying or neutering, including undescended testes. We recommend waiting until the puppy is 1-3 years of age before spaying or neutering because studies show less risk of cancer and hip dysplasia. Failure of the Purchaser to provide puppy with regular veterinary care will void this Health Guarantee. Purchasers should follow a recommended nutritional program, including feeding only premium dog foods and vitamin supplements. All dogs should not be over exercised during their growth period. Temperament issues are not covered under this Health Guarantee as they can be caused by a number of factors outside control of Seller or the breeder including, without limitation, lack of training, discipline or proper dog socialization. The owner/buyer is responsible for all transportation costs to and from the Seller.

Seller reserves the right to refuse purchase of a puppy for any reason. It is guaranteed that at no time will the new owner sell or give to a pet store, puppy mill, surrender to an animal shelter or rehome without letting the breeder be involved. The breeder will be notified if the owner cannot take care of said Puppy due to hardship or unforeseen events in their living situation.
